Rules & Regulations

Der Stadt Friedhof (The City Cemetery)

Adopted February 11, 2026

  1. Written authorization from the recorded owner of a burial space, a designated representative, a successor in interest or other proper legal authority and payment in full will be required for interment or inurnment.  Only human remains will be allowed for interment or inurnment within the boundaries of the cemetery.  
     

  2. Arrangements for interment or inurnment will be made through the funeral home handling the disposition of the remains. Sufficient and proper notice of intended interment or inurnment shall be given to the administrator in charge of the records to assist in record keeping and recording death dates.  
     

  3. The Cemetery Board requires only pre-approved licensed and insured contractors and funeral directors shall be allowed to open or close graves to inter remains or for approved personnel to inter cremains in an approved location.  
     

  4. Contractors and others are required to interrupt their work pending a nearby funeral service or procession.
     

  5. All interment or inurnment and disinterment or disinurnment shall be performed under the supervision of a licensed funeral director or of the Cemetery Board and in accordance with the laws of the State of Texas.
     

  6. A permanent concrete liner or a burial vault is required for interments. Containers for cremated remains shall be of material approved by the Cemetery Board.  
     

  7. The contractual agreement concerning interment or inurnment gives only the right or privilege of interment or inurnment. All property and structures remain always within the ownership of The Der Stadtische Friedhof (City Cemetery) Fredericksburg, Inc. 
     

  8. The purchaser of the right of interment in a lot, plot or grave is required to provide a headstone, marker or monument for the purpose of identifying remains. All headstones, markers or monuments shall be installed by a Cemetery Board approved supplier / installer. 
     

  9. The granite faceplate of the columbarium niche will be engraved at the time of purchase with the information available. Death dates will be added at the appropriate time.  Inscriptions shall be uniform and approved by the Cemetery Board.    
     

  10. All headstones, markers, monuments or niche faceplates shall be made of a permanent material and maintain the dignity of the area in which they are installed.  Any questions regarding the appropriateness of a design, color or material should be directed to the Cemetery Board before being ordered or installed. The Cemetery Board shall have final approval.
     

  11. Only one body or cremation shall be interred or inurned in a grave space or columbarium niche unless previous authorization has been given at the time the Plot or Niche Purchase Agreement is executed or at such later date as long as the owner of the right of interment or inurnment in such grave space or columbarium niche has given written authorization to the administrator in charge of the cemetery records.  
     

  12. If written authorization has been given by the owner of the right of interment or inurnment, the maximum number of interments or inurnments in a single grave space or niche shall be two (2). Provided, however, that in no event will more than one (1) casket be allowed in a single grave space.
     

  13. No transfer of ownership of rights in a lot, plot, grave or niche shall be considered valid until the administrator in charge of the cemetery records is notified and the transfer is recorded as valid.
     

  14. Graves or niches will receive a final closure in accordance with the design of the section in which the person is being laid to rest and according to the terms of the contract executed at the time of purchase. 
     

  15. The Cemetery Board will not be held liable for any errors which incorrectly identify the person to be interred or inurned, the space for interment or inurnment or any delay that occurs by such error or any error that occurs due to failure to follow these Rules and Regulations.
     

  16. The Cemetery Board will not accept any donations identified for the care of a specific lot, plot, grave, niche or name. All donations accepted will be for general purposes or an endowment fund. 
     

  17. Motorized vehicles shall not be driven at a speed exceeding 10 miles per hour.
     

  18. The cemetery will close at dusk and open at dawn. Entry into the cemetery grounds between dusk and dawn is prohibited. Anyone found on the property between the hours of dusk and dawn will be considered a trespasser.
     

  19. Everyone, adult and child, shall conduct themselves in a manner as not to disturb the quiet. Walking on or standing on graves is not permitted. 
     

  20. All persons are reminded that the cemetery grounds are hallowed. Any individuals caught, at any time, loitering, camping, sleeping, preparing food, using fire or conducting other inappropriate activities will be expelled and may be prosecuted for trespassing. The Cemetery Board reserves the right to determine what activities are deemed inappropriate.
     

  21. Care shall be taken not to damage or deface any headstone or monument during maintenance or lawn care activities.  
     

  22. Items placed on graves that impede maintenance or are deemed inappropriate may be removed.
     

  23. The Cemetery Board prohibits any plaques or stickers affixed to the niche front except for approved military emblems, artificial only flower vases and cameos.   
     

  24. Flower containers should be weighted or anchored.  Glass containers are not allowed. Faded flowers or broken decorations may be removed.
     

  25. Flags that have not been cared for will be removed and disposed of according to proper protocol.
     

  26. The Cemetery Board has the right to specify all costs and terms of interment or inurnment.
     

  27. No signs shall be permitted other than those approved and installed under the supervision of or by the Cemetery Board.
     

  28. The Cemetery Board is not responsible for acts of God, vandalism, theft or any other type of damage.
     

  29. Only the Cemetery Board has the right to make a temporary exception, suspension, or modification to these Rules and only if doing so does not violate any Health and Safety Codes or existing laws.
     

  30. The Cemetery Board reserves the perpetual right of ingress and egress over all spaces within the cemetery boundaries for the purposes of operation, maintenance and management of the property.
     

  31. The Cemetery Board reserves the right to modify, amend, change, alter, repeal or adopt new Rules and Regulations or restrictions as situations and policy may require.
     

  32. The statement of any volunteer, Cemetery Board member, church employee, contractor or funeral director shall not be binding on the Cemetery Board unless the statement agrees with the contract conveying the right to interment or inurnment, these Rules and Regulations, Health and Safety Codes and any existing laws.
